AMS Kasilov is a sole proprietorship (Einzelunternehmen) based in Bern, Switzerland. We specialise in premium 1:18 scale collector model cars from manufacturers such as CMC, Exoto, and BBR.

VAT: AMS Kasilov is currently exempt from Swiss VAT (annual turnover below the CHF 100,000 registration threshold). Displayed prices are final prices in CHF and include no additional taxes.

2. Scope and acceptance

These Terms and Conditions (“T&C”) apply to all orders placed through the AMS online shop at ams-models.ch.

By completing a purchase — specifically by ticking the acceptance checkbox during checkout — you confirm that you have read, understood, and accepted these T&C in full. If you do not agree, please do not place an order.

These T&C govern the relationship between AMS (seller) and the customer (buyer) for all transactions. Deviating terms proposed by the buyer are not accepted unless confirmed in writing by AMS.

3. Contract formation

3.1 The display of products in our online shop constitutes a binding offer by AMS to sell those items at the stated prices and conditions.

3.2 A purchase contract is concluded at the moment the buyer completes checkout and receives an order confirmation e-mail from AMS. The order confirmation summarises the items purchased, the total price, and the delivery address.

3.3 AMS reserves the right to reject or cancel orders in the following cases:

  • Obvious pricing errors
  • Items found to be unavailable after order submission
  • Suspected fraudulent activity
  • Inability to verify delivery address

In such cases, AMS will notify the buyer promptly and provide a full refund of any amount already paid.

3.4 All offers are subject to availability. AMS maintains a single inventory; in the rare event of simultaneous orders for the same item, the first confirmed payment takes precedence.

4. Prices and payment

4.1 Pricing
All prices are stated in Swiss Francs (CHF). Prices are final and include no additional taxes (AMS is VAT-exempt; see Section 1). Shipping costs are shown separately before order completion.

4.2 Payment methods
AMS accepts the following payment methods:

  • TWINT — instant mobile payment
  • PostFinance — PostFinance Card or e-finance
  • Credit card — Visa, Mastercard
  • PayPal
  • Bank transfer — advance payment; details provided in order confirmation

4.3 Payment timing
Payment is due immediately upon order placement. For bank transfer, payment must be received within 7 calendar days of the order confirmation. Items are reserved during this period; if payment is not received within 7 days, the reservation lapses and the item may be sold to another buyer.

4.4 Title retention
Ownership of goods remains with AMS until payment has been received in full.

5. Shipping and delivery

5.1 Delivery area
AMS ships exclusively to addresses within Switzerland. International shipping is not currently available.

5.2 Shipping method
All orders are shipped via Swiss Post Priority with parcel tracking and insurance included.

5.3 Shipping costs

  • CHF 16.00 flat rate for orders under CHF 300
  • Free shipping for orders of CHF 300 or more

5.4 Dispatch time
Orders are typically dispatched within 1–2 business days of payment confirmation (Monday–Friday, excluding Swiss public holidays).

5.5 Delivery time
Swiss Post Priority typically delivers within 2–4 business days of dispatch. Delivery times are estimates and cannot be guaranteed.

5.6 Risk of loss
Risk of loss or damage in transit passes to the buyer upon handover of the parcel to Swiss Post. All shipments are insured; see Section 9 for transit damage claims.

5.7 Delivery address
AMS does not deliver to P.O. boxes. Please provide a valid residential or business address. If a parcel cannot be delivered, Swiss Post will leave a collection notice and hold the parcel for 7 days. Uncollected parcels returned to AMS may incur a re-delivery charge.

5.8 Packaging
All models are packed with protective materials appropriate to the item’s value and fragility. We take particular care with the original manufacturer packaging, which often carries significant collector value.

6. Product information and condition

6.1 Product descriptions include manufacturer, item number, scale (1:18 unless otherwise stated), year, edition details, and any known variations.

6.2 Each item is assigned a condition grade for both the model and its packaging according to our Condition Grading System. We warrant that the condition described matches the actual item at the time of shipment.

6.3 Product photos are taken under studio lighting. Actual colours may vary slightly depending on viewing environment and screen calibration. These variations are not grounds for return.

6.4 Hand-crafted models (particularly CMC) may exhibit minor production variations in paint shade, decal placement, or small detail finishes. These are inherent to the manufacturing process and are not defects.

6.5 Where items are described as limited editions or with specific edition numbers, this information is accurate to the best of our knowledge at the time of listing.

7. Warranty (Gewährleistung)

7.1 Warranty period
Pursuant to the Swiss Code of Obligations (OR, Art. 197 ff.):

  • New goods: 2 years from the date of delivery
  • Used / pre-owned goods: 1 year from the date of delivery

7.2 Scope — what constitutes a defect
A warranty claim is valid only where a defect:

  • Was present at the time of delivery (not arising afterwards)
  • Was not disclosed in the product listing (description, condition grade, or photos)
  • Causes the item to materially differ from the written product description

The following are explicitly not defects under this warranty:

  • Any condition, wear, marking, or characteristic consistent with the item’s stated condition grade
  • Any imperfection visible in the product photos provided at time of purchase
  • Normal aging, oxidation, patina, or material changes inherent to collector items over time
  • Missing parts or accessories where their absence is stated in the product listing
  • Damage arising after delivery from handling, display, storage, or accidents

7.3 Notification requirement
The buyer must notify AMS of any defect promptly upon discovery and in any case within the applicable warranty period. Notification must be made in writing to info@ams-models.ch and must include the order number, a description of the defect, and clear photographs. Failure to notify promptly after discovery may extinguish the warranty claim (OR Art. 201).

7.4 Remedy
AMS shall, at its sole discretion, remedy a valid warranty claim by one of the following, in order of preference:

  1. Repair of the item
  2. Replacement with an equivalent item
  3. Reduction of the purchase price
  4. Refund of the purchase price upon return of the item

No claim may be made for indirect, consequential, or incidental losses beyond the purchase price of the item.

8. Returns

8.1 No statutory right of return
Under Swiss law, there is no statutory right of return or withdrawal period for online purchases (unlike EU regulations). Returns are accepted by AMS on a voluntary basis under the conditions below.

8.2 Voluntary 14-day return window
AMS accepts returns within 14 calendar days of delivery for items that are:

  • In original, unused condition
  • In original packaging, undamaged
  • Accompanied by the original order confirmation

To initiate a return, contact info@ams-models.ch within 14 days of delivery with your order number. We will confirm the return and provide a return address.

8.3 Non-returnable items
The following are not eligible for return under the voluntary policy:

  • Items delivered in a factory-sealed manufacturer box — sealed-box deliveries are final sales. Once a factory-sealed item leaves our possession we cannot verify that it has not been opened and resealed. Sealed-box items are clearly identified as such in the product listing.
  • Pre-owned / used items sold “as described”, unless defective
  • Items with clear damage, signs of use, or missing accessories not present at time of delivery
  • Items returned outside the 14-day window

8.4 Return shipping costs

  • Change of mind / voluntary return: The buyer bears the cost of return shipping.
  • Defective or misdescribed items: AMS bears the cost of return shipping.

8.5 Refund processing
Refunds are processed within 7 business days of receiving the returned item and confirming its condition. Refunds are issued via the original payment method.

9. Transit damage

9.1 Please inspect your parcel upon delivery. If the outer packaging shows signs of damage, note this with the delivery driver or postal worker if possible.

9.2 If the model or its original packaging has been damaged in transit, please:

  1. Photograph both the outer shipping box and the item immediately upon opening
  2. Report the damage to Swiss Post within 5 calendar days of delivery
  3. Notify AMS at info@ams-models.ch within 5 calendar days with photos and your order number

9.3 AMS will file the insurance claim with Swiss Post on your behalf. Upon confirmation of the claim, we will arrange a replacement or issue a refund.

9.4 Claims submitted after 5 days may be refused by Swiss Post, which would limit our ability to resolve the issue. We therefore strongly encourage prompt reporting.

10. Liability

10.1 Unlimited liability
AMS maintains unlimited liability for:

  • Death or personal injury caused by AMS’s negligence
  • Gross negligence or wilful misconduct
  • Fraud or fraudulent misrepresentation

10.2 Limited liability
For all other claims, AMS’s liability is limited to direct, foreseeable damages at the time of contract formation. The maximum liability is the purchase price of the item in question.

10.3 Excluded losses
AMS is not liable for:

  • Indirect or consequential damages
  • Loss of profit, revenue, or business opportunity
  • Changes in collector or market value of purchased items
  • Damage arising from the buyer’s failure to follow care or storage instructions

11. Data protection

AMS processes personal data (name, delivery address, e-mail, payment information) solely for the purpose of order fulfilment, shipping, and customer service.

Data is processed in accordance with the Swiss Federal Act on Data Protection (nDSG), which entered into force on 1 September 2023.

Key principles:

  • Your data is not sold or shared with third parties for marketing purposes
  • Data is shared with third-party service providers only as necessary for order fulfilment (Swiss Post for shipping; payment processors for payment handling)
  • Data is retained for the duration required by Swiss accounting and tax law (10 years)
  • You have the right to access, correct, and request deletion of your personal data

12. Intellectual property

All content on the AMS website — including product descriptions, photographs, logos, and design — is the property of AMS Kasilov or its licensors and is protected by Swiss and international copyright law. Reproduction without prior written consent is prohibited.

Brand names and trademarks mentioned on this site (CMC Classic Model Cars, Exoto, BBR Models, Ferrari, Mercedes-Benz, Maserati, Auto Union, and others) are the property of their respective owners. Their appearance on this site does not imply any affiliation with or endorsement by those brands.

13. Amendments

AMS reserves the right to amend these T&C at any time. Updated T&C will be published on the website with a revised “Last updated” date. Changes apply to orders placed after the date of publication. Registered customers will be notified of material changes by e-mail.

Your continued use of the AMS online shop after changes are published constitutes acceptance of the revised T&C.

14. Governing law and jurisdiction

These T&C and all transactions through the AMS online shop are governed exclusively by Swiss law, in particular the Swiss Code of Obligations (OR).

Any disputes arising from or in connection with these T&C or individual transactions shall be submitted to the exclusive jurisdiction of the civil courts of Bern, Switzerland.

If you are a consumer resident in Switzerland, you also retain the right to bring claims before the courts of your canton of domicile.

15. Severability and complaints

15.1 Severability
Should any provision of these T&C be found invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision will be replaced by a valid provision that most closely reflects the original commercial intent.
